DEFINITIONS
For the purposes of these Terms of Service:
“Poop Scoopers NC,” “we,” “us,” and “our” refer to Poop Scoopers NC, LLC, including its owners, officers, managers, employees, contractors, subcontractors, agents, affiliates, successors, and assigns. “Client,” “you,” and “your” refer to the person, household, property manager, HOA, community, or organization receiving our Services. “Services” refers to pet waste removal and any related services provided by Poop Scoopers NC.
SERVICE AGREEMENT
By signing up for Services, accepting a quote, approving a proposal, checking an online acceptance box, or otherwise authorizing service, you agree to these Terms of Service. Services are provided on a month-to-month recurring basis. IMPORTANT: Your service automatically renews each month unless you cancel it according to the Cancellation section below.
SERVICE SCOPE
Unless otherwise agreed in writing, Services are limited solely to the collection and removal of pet waste.
Poop Scoopers NC does not provide property inspections, fencing inspections, gate inspections, animal monitoring, veterinary services, landscaping services, lawn care services, pest control services, security services, or any other service not specifically included in the Client’s selected service plan.
PAYMENT
Payment is due according to the service plan you selected when signing up. By enrolling in service, you authorize Poop Scoopers NC to securely store your payment method and charge it for recurring services and any applicable fees outlined in these Terms. If your payment method fails, you must provide updated payment information within seven (7) calendar days of notification. Failure to do so may result in suspension or cancellation of service. Any unpaid balance that remains outstanding for more than fifteen (15) days after the due date may be subject to a late fee of $15.00 or 1.5% of the outstanding balance per month, whichever is greater, to the maximum extent permitted by law. You are responsible for any reasonable collection costs, attorney’s fees, court costs, or expenses incurred in collecting unpaid balances.
REFUNDS
Because we reserve time on our schedule and perform services based on your selected service plan, payments are generally non-refundable. If we make a billing error, we will correct it promptly. Approved refunds, if any, may exclude payment processing fees, bank fees, and prorated service charges. Account credits may be issued at our discretion and applied to future services.
CANCELLATION
You may cancel service at any time without cancellation penalties or fees. To ensure accurate recordkeeping, cancellation requests must be submitted by email to [hello @ poopscoopersnc.com] If a cancellation request is made by phone, text message, social media message, or any other method, it will not become effective until confirmed by email. Billing and services will continue until written cancellation is received and confirmed. Any outstanding balance for services already provided remains due and payable.
COMMUNICATIONS
By providing your phone number and email address, you agree to receive calls, text messages, and emails related to scheduling, customer service, billing, collections, service updates, and account management. Where permitted by law, these communications may be sent using automated systems. You also agree that electronic documents, invoices, notices, disclosures, agreements, and other records may be provided electronically rather than in paper form.
ELECTRONIC ACCEPTANCE
Electronic signatures, online acceptance forms, checkbox acknowledgments, emailed approvals, and similar electronic actions carry the same legal effect as a handwritten signature.
SATISFACTION GUARANTEE
If you are unhappy with a cleanup, please contact us within twenty-four (24) hours of service completion. We will make reasonable efforts to revisit and address the concern. After twenty-four (24) hours, the service visit will be considered complete and accepted.
LEAVES, TALL GRASS, AND YARD CONDITIONS
We work hard to provide a thorough cleanup during every visit. However, tall grass, leaves, brush, overgrown vegetation, tree branches, yard waste, toys, outdoor furniture, landscaping materials, and other yard obstructions can make pet waste difficult or impossible to locate. Our Satisfaction Guarantee does not apply when pet waste is concealed by yard conditions beyond our reasonable control. By failing to maintain the service area in a reasonably clear and accessible condition, you waive any claim for a complimentary revisit, refund, credit, or service adjustment related to pet waste hidden by such conditions. While we make every reasonable effort to locate and remove all visible pet waste during service, we cannot guarantee the removal of waste concealed by visual obstructions or other conditions that limit visibility. If yard maintenance or removal of obstructions occurs after service, any previously concealed pet waste may be addressed during a future scheduled service visit. Concerns regarding service quality must be reported within twenty-four (24) hours of service completion.
NO GUARANTEE OF COMPLETE WASTE REMOVAL
Pet waste removal is a visual service. Factors such as weather conditions, grass height, leaves, ground cover, landscaping, lighting conditions, waste consistency, and other environmental conditions can impact visibility. While we strive to provide a thorough cleanup every visit, we cannot guarantee that every individual piece of pet waste will be located and removed.
SERVICE DAYS AND SCHEDULING
Service times are not guaranteed and may vary due to route optimization, weather, staffing, traffic, equipment issues, holidays, or other operational factors. Services are generally performed between sunrise and sunset. We reserve the right to adjust, combine, reschedule, or modify service days when reasonably necessary for safety, weather, scheduling efficiency, holidays, or operational needs. If a service visit is delayed, missed, or rescheduled, we may perform the service on an alternate day or combine it with a future visit. These adjustments do not qualify for refunds, discounts, credits, or fee reductions. Holiday weeks are included in your regular monthly service pricing. No refunds or credits are provided for holiday scheduling adjustments.
PROPERTY ACCESS
Please make sure we can safely access the areas that require service. Gates should be unlocked and free from obstructions. Aggressive animals should be secured before our arrival. If we are unable to access the service area, you may still be charged for the scheduled visit. While we make reasonable efforts to close and secure gates after service, you remain responsible for maintaining safe and secure fencing, gates, latches, locks, and animal containment systems. Poop Scoopers NC is not responsible for failures caused by pre-existing defects, wear and tear, weather, misuse, or circumstances outside of our control.
CLIENT PRESENCE AND ACCESS
The Client is not required to be present during service. By providing access to the property, the Client authorizes Poop Scoopers NC to enter the designated service areas for the purpose of performing Services.
DOG CONTAINMENT AND ESCAPE RESPONSIBILITY
The Client remains solely responsible for the supervision, control, and containment of all animals on the property. While Poop Scoopers NC makes reasonable efforts to close and secure gates after service, the Client acknowledges that gates, latches, fencing systems, and animal containment systems may fail due to pre-existing defects, wear and tear, weather conditions, improper installation, misuse, interference by third parties, or other circumstances beyond our control. The Client agrees not to rely on the arrival, departure, presence, or gate-closing procedures of Poop Scoopers NC for the containment or supervision of any animal. Poop Scoopers NC shall not be responsible for the escape, loss, injury, illness, death, impoundment, or behavior of any animal resulting from conditions beyond our reasonable control.
PROPERTY CONDITIONS
If your property contains hidden sprinkler heads, irrigation systems, invisible fencing, drainage systems, landscape lighting, underground utilities, garden features, decorations, toys, or other difficult-to-see items, please identify or clearly mark them before service. Poop Scoopers NC is not responsible for damage to concealed, partially concealed, or otherwise difficult-to-see property features that are not readily visible during normal service operations.
NORMAL YARD CONDITIONS
The Client acknowledges that Services may require walking through wet grass, muddy areas, uneven terrain, leaves, pine straw, gravel, mulch, and other common outdoor conditions.
Poop Scoopers NC shall not be responsible for minor turf disturbance, footprints, soil compression, mud transfer, grass wear, or similar incidental effects resulting from the normal performance of Services.
AGGRESSIVE ANIMALS
For the safety of our team, we will not enter areas containing aggressive, threatening, uncontrolled, or potentially dangerous animals. If we are unable to complete service because of animal behavior, you may still be charged for the scheduled visit. You are responsible for any injuries, medical expenses, property damage, lost wages, legal expenses, or other costs resulting from the actions of your animals. We reserve the right to refuse, suspend, or discontinue service whenever safety concerns exist.
DISCLOSURE OF ANIMAL BEHAVIOR
The Client agrees to disclose any known history of aggressive, threatening, territorial, protective, biting, attacking, chasing, or otherwise dangerous behavior by any animal located on the property. The Client further agrees to promptly notify Poop Scoopers NC of any change in an animal’s behavior that could reasonably create a safety risk for employees, contractors, visitors, or other persons. Failure to disclose known animal behavior may result in immediate suspension or termination of Services.
BIOHAZARDS AND UNSAFE CONDITIONS
For the safety of our team, Poop Scoopers NC reserves the right to refuse, suspend, postpone, or discontinue Services if hazardous conditions exist on the property.
Examples include, but are not limited to, human waste, used needles, broken glass, animal carcasses, chemical spills, biohazards, dangerous debris, criminal activity, unsafe structures, flooding, standing sewage, or any condition that creates an unreasonable risk of injury, illness, or property damage.
ASSUMPTION OF RISK AND RELEASE OF LIABILITY
IMPORTANT: Pet waste removal services involve risks that cannot be completely eliminated, even when reasonable care is used.
These risks may include interactions with animals, uneven ground, holes, insects, wildlife, landscaping features, weather conditions, gates, fences, and other hazards commonly found on residential and commercial properties. By using our Services, you acknowledge these risks and agree that Poop Scoopers NC cannot be held responsible for injuries, losses, or damages arising from conditions beyond our reasonable control.
CLIENT RESPONSIBILITIES AND INDEMNIFICATION
You agree to maintain your property in a reasonably safe condition and to disclose any known hazards, including aggressive animals, damaged fencing, unsafe gates, hidden obstacles, standing water, hazardous materials, construction hazards, sinkholes, or similar dangers.
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Poop Scoopers NC and its owners, officers, employees, contractors, subcontractors, agents, affiliates, successors, and assigns from claims, damages, losses, liabilities, costs, expenses, and attorney’s fees arising from: injuries or damages caused by your animals; unsafe, defective, or hazardous property conditions; failure to disclose known hazards; violations of laws or regulations relating to your property; or claims brought by third parties arising from conditions existing on your property.
This indemnification obligation includes claims brought by family members, tenants, guests, invitees, neighbors, visitors, delivery personnel, contractors, service providers, governmental entities, or other third parties arising from conditions on the property or the actions of the Client’s animals.
SERVICE DOCUMENTATION
To help with quality control, employee training, service verification, insurance matters, legal compliance, dispute resolution, and operational recordkeeping, we may photograph, record, or otherwise document portions of your property before, during, or after service. We will not use photographs or videos for advertising, marketing, social media, website content, or other public-facing purposes without your separate permission. Such records may be relied upon as evidence of service completion, property conditions, and communications between the parties.
SERVICE RECORDS
The Client agrees that photographs, videos, GPS records, timestamps, route records, service logs, communication records, and other business records maintained by Poop Scoopers NC may be used to verify service completion, document property conditions, resolve disputes, and support insurance, legal, or collection matters.
SERVICE INTERRUPTIONS AND EVENTS BEYOND OUR CONTROL
Poop Scoopers NC is not responsible for delays, interruptions, or inability to perform services caused by events beyond our reasonable control, including severe weather, natural disasters, public emergencies, governmental actions, utility outages, labor shortages, transportation disruptions, equipment failures, or other circumstances beyond our reasonable control.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, the total liability of Poop Scoopers NC arising out of or relating to our Services shall not exceed the total amount paid by you for Services during the three (3) months immediately preceding the event giving rise to the claim. Under no circumstances shall Poop Scoopers NC be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, loss of use, emotional distress, business interruption, property value reduction, or similar damages.
WAIVER OF CONSEQUENTIAL DAMAGES
Both you and Poop Scoopers NC agree that neither party may recover indirect, incidental, special, consequential, punitive, or exemplary damages arising from or relating to the Services, including claims for lost profits, business interruption, emotional distress, loss of use, or similar losses.
DISPUTE RESOLUTION, ARBITRATION, AND VENUE
These Terms of Service are governed by the laws of the State of North Carolina. If a dispute arises, both parties agree to first attempt to resolve the matter through good-faith discussions. If the dispute cannot be resolved informally, the parties agree to participate in mediation before pursuing arbitration or litigation. Except for claims that qualify for small claims court, any dispute arising out of or relating to these Terms or our Services shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its applicable Consumer Arbitration Rules. Arbitration shall take place in Moore County, North Carolina, unless both parties agree otherwise. For matters not subject to arbitration, including collection actions and enforcement of arbitration awards, the parties agree that Moore County, North Carolina shall be the exclusive venue and jurisdiction. Nothing in this section prevents Poop Scoopers NC from pursuing collection actions, recovering unpaid balances, or seeking temporary legal relief where permitted by law. The prevailing party in any collection action shall be entitled to recover reasonable attorney’s fees, court costs, collection costs, and related expenses.
SEVERABILITY
If any portion of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
SURVIVAL OF OBLIGATIONS
The indemnification, limitation of liability, arbitration, dispute resolution, payment, collection, and other provisions that by their nature are intended to survive termination shall remain in effect following the cancellation or termination of Services.
NO WAIVER
Failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision in the future.
ENTIRE AGREEMENT
These Terms of Service represent the entire agreement between you and Poop Scoopers NC and supersede any prior discussions, understandings, representations, or agreements, whether written or verbal.
No employee, contractor, technician, representative, or agent of Poop Scoopers NC has authority to modify these Terms verbally.
Any modification, waiver, or exception to these Terms must be made in writing and approved by an authorized representative of Poop Scoopers NC.
