Terms of service

Even Poop-Scooping Needs Fine Print!

TERM
These Terms of Service are entered into between the Client (the individual or entity accepting these terms) and Poop Scoopers NC (hereinafter referred to as the “Service Provider”). Upon acceptance of either the Service Provider’s paper Proposal and Estimate (for Community clients) or Fee Quote online (for individual clients) (each referred to as the “Services”), these Services shall continue indefinitely and on a recurring basis until canceled in accordance with these Terms of Service.

FEE PAYMENT
Payment is due in accordance with the payment plan selected by the Client at the time of accepting the Services. In addition to any amounts owed to the Service Provider, the Client agrees to be responsible for all reasonable collection and attorney’s fees the Service Provider may incur in seeking to bring the Client’s account current.

PAYMENT METHOD
At the time of acceptance of the Services, the Client shall submit to the Service Provider a valid credit card for processing payment in accordance with the terms of this Service Agreement. The Client consents to the Service Provider storing their credit card information and charging the card for fees owed under this agreement.

If payment is not received before the first cleanup of the month, the Client will be removed from the service schedule until payment is processed. Services billed for the month are non-refundable. If the Client cancels, the Service Provider will still clean for the remainder of the month upon request.

Should the Client’s credit card payment fail, additional fees may apply. If the Client does not provide an updated payment method within seven (7) calendar days of notice from the Service Provider, the Service Provider may terminate this Service Agreement.

REFUNDS
The Service Provider does not offer refunds for payment of Services unless the error is attributable to the Service Provider. Refunds issued for other reasons will exclude bank/credit card processing fees and prorated service charges, if applicable. Account credits may be granted on a case-by-case basis and either applied to the following month’s invoice or held on the Client’s account without expiration.

CANCELLATION
The Client may cancel their Services at any time for any reason without penalty or payment of a cancellation fee. To request cancellation, the Client must call ‪(910) 556-3424‬ or email hello@poopscoopersnc.com. Payment for Services rendered prior to cancellation and owed by the Client shall be due and payable at the time the Client’s Services are terminated.

CONSENT TO CONTACT
By providing a cell phone number and/or email address, the Client consents to receiving calls, text messages, or emails, including those made by automated systems, regarding billing, collections, or customer care services.

With the Client’s permission, electronic versions of documents (e.g., notices, disclosures, records) may be provided instead of paper copies. Documents will be sent to the email address provided by the Client.

Providing consent does not guarantee all communications will be electronic.

SATISFACTION GUARANTEE
If the Client is not completely satisfied with any Service, the Service Provider will make every effort to revisit on the same day. Revisit requests must be made within 24 hours of the completed Service. After this period, work is considered final, and no complimentary revisits will be provided.

LEAVES, DEBRIS, AND TALL GRASS
The Client acknowledges that tall grass, leaves, or debris may hinder the Service Provider’s ability to locate all dog waste. Missed waste will be addressed during the next visit if yard maintenance has been completed. For excessive missed waste, the Client must contact the Service Provider within 24 hours of Service completion by phone or text at ‪(910) 556-3424‬.

SERVICE TIMES AND DAYS
Service times are not time-specific due to routing variables. Service hours are from sunrise to sunset. Services will proceed in most weather conditions unless deemed unsafe, in which case Services will be paused, and affected Clients notified. Service Provider reserves the right to reschedule or adjust Service days.

The Client’s monthly fee covers holidays observed by the Service Provider, including New Year’s Day, Memorial Day, Independence Day, Labor Day, Thanksgiving, and Christmas week (or the week before/after if Christmas falls on a weekend).

PERFORMANCE OF SERVICES
The Client must ensure gate access is unobstructed (e.g., no dogs, padlocks, or furniture). If access is blocked, the Client will be notified and charged for the visit. While the Service Provider attempts to secure gates, ultimate responsibility for gate security lies with the Client.

AGGRESSIVE ANIMALS
The Service Provider will not work in areas with aggressive animals. If access is restricted due to aggressive behavior, the Client will be notified and charged for the visit. If an employee is bitten, medical fees will be the Client’s responsibility. The Service Provider reserves the right to refuse service for unsafe conditions.

SERVICE DELAYS AND FORCE MAJEURE
The Service Provider shall not be liable for delays caused by events beyond its control, including severe weather, natural disasters, governmental actions, or other force majeure events. Such delays do not constitute a breach of this agreement.

ENFORCEABILITY
If any part of these Terms of Service is deemed unenforceable by a court, the remaining provisions shall remain in effect.

DISPUTES
This agreement is governed by the laws of the State of North Carolina. Disputes unresolved through direct communication will be settled by mediation administered by the American Arbitration Association. Mediation costs shall be shared equally by both parties. The Service Provider retains the right to pursue collection actions, with the Client responsible for all associated fees.

LIQUIDATED DAMAGES
If the Client terminates Services or breaches this agreement, the Service Provider may retain all payments as liquidated damages and not as a penalty.

NO WAIVER OF RIGHTS
Failure by the Service Provider to enforce any provision does not waive its right to enforce that or any other provision in the future.

ENTIRE AGREEMENT
These Terms of Service constitute the entire agreement between the Client and the Service Provider, superseding all prior agreements. No oral promises or agreements are part of this agreement.
